Sites means the websites, mobile, desktop and browser apps (applications), official social media platforms, or other online properties through which MKVS offers the Services and which has posted or linked to this webpage. Sites include but are not limited to nstreatment.org, https://getmkvs.com .
1.1.5. User means an individual who uses the Services or accesses the Sites. Furthermore User means an individual who books and / or purchases any sessions or services offered and sold by NST. User is sometimes referred to as "Users", “customer”, “customers”, “client”, “clients”, "the Contractor", ”patient”, “patients”, “you”, “your”, “yours” depending on the context.

1.1.6. Products or goods means any physical, digital or intellectual products, items, properties or goods that NST is offering for sale for Users on its Sites. Products or goods are sometimes referred to as “product”, "products", ”goods”, “gift card”, “gift cards”, “item”, “items” depending on the context.
1.1.7. Account means a NST / MKVS member account registered by a User on https://getmkvs.com .
1.1.8. Instructor means the person who conducts the services to clients. Majority of the times it is the creator and co-owner of NST, namely Søren Sedit. Instructor is sometimes referred to as “SS”, "Søren Sedit", “Soren Sedit” "Søren", "Soren" depending on the context.
1.1.9. Data Controller means that NST determines the purposes and means of the processing of Personal Data.
1.1.10. Device Information means data that can be automatically collected from any device used to access the Sites or Services. Such information may include, but is not limited to, your device type; your device’s network connections; your device’s name; your device IP address; information about your device’s web browser and internet connection you use to access the Site or Services; Geolocation Information; information about apps downloaded to your device; and biometric data.

Please make sure you read and understand the MKVS T&Cs of Use as it is an extension of the NST Terms and Conditions of Use and by accepting the terms and conditions on this Site (NST) you automatically accept and agree to the MKVS T&Cs of Use as well.

1.3. Payment terms

1.3.1. For online payment transactions at NST (on NST sites) all major credit and debit cards are acceptable payment methods for NST services and other purchases and they are processed primarily via Stripe ™ secure payment processing platform. By default RMS requests the payment to be made through the NST booking page (https://nstreatment.org/book) or within the official NST mobile application for Android and iPhone where payment is available by manually entering your card details, or using Apple Pay or Google Pay provided by Stripe ™.
If for any reason the previously mentioned payment processing methods fail to take payment from your card, please get in touch with us and we can then offer alternative payment methods. PayPal ™ as a secondary payment option may be offered to you by NST or alternatively, direct BACS transfer can be also accepted but this will also have to be confirmed by NST first.
Cash or cheque payments are not acceptable under any circumstances.
1.3.2. ​NST reserves the right to change fees and prices of services, bundles, packs, sessions and goods anytime without prior notice. All fees and prices of NST services and goods are displayed in GBP currency and they are always inclusive of all taxes and VAT.

2. Trademarks
2.1. Our Rights To Register and Use MKVS Trademarks

2.1.1. Copyright owners of the name “The Master-Key Vocal System” as well as “MKVS” and the scientific paperwork titled “The Master-Key Vocal System” (assigned reference number: “MKVS1.0/auth2020”) Søren Sedit and Hekker Bros. Ltd has been granted unlimited permission to Hekker Bros. Ltd to register the trademarks for business purposes and legally trade as “Neuro Sound Treatment” and “NST”.

2.2. Trademarks on Sites

2.2.1. The use of Sites and any information contained on these Sites does not grant a license to the visitor or the User to use any of the trademarks or official marks of NST or MKVS.

2.3. The Limited Use of MKVS Trademarks

2.4.9. Social Media Guidelines
The name of your social media account, any and all pages or communities, cannot begin with a NST or MKVS trademark. In addition, NST and MKVS logos cannot be used in a way that might suggest affiliation with NST or MKVS, including, but not limited to, the account, profile, or header images.
2.4.10. The only exceptions to these requirements are if
(1) you’ve secured permission from NST through a license or equivalent (though such licenses are not generally available in this context); or
(2) you’re using a NST or MKVS trademark (not including logos) to describe the purpose of your account, page, or community provided that:
you are not suggesting affiliation with or endorsement by NST or MKVS; and,
your account does not use the name or likeness of any prominent individuals within NST and MKVS.
For example, you cannot name your account, page, or community “NST patients” or “NST Official.” However, it would be acceptable to name your account, page, or community “Fans of NST” or “Information about NST” as long as you do not use the NST or MKVS logos or otherwise suggest any affiliation with NST or MKVS.

In addition to this, the Content is also protected by The Berne Convention, WIPO (World Intellectual Property Organization) Copyright Treaty and the The Agreement on Trade Related Aspects of Intellectual Property Rights.

We may request these personal details of yours in order to legally comply with applicable laws that require such data to be present on agreements and contracts (such as NDA and Liability Waiver) that we need you to sign in order to use our Services.

5. Booking, Cancellation and Refund Policy
5.1. Booking Policy

5.1.1. In order to book or purchase any of our services, products or goods, you must be at least 16 years of age or older.
5.1.2. All NST bookings must be fully paid for in advance (with the exception of the free of charge services such as FREE Consultation). Failure to clear payments within the time interval given by the payment processing platform during online booking / purchase will incur the cancellation of the session(s) and payment.
5.1.3. Please note that you are able to book an appointment with NST with a minimum of 24 hours ahead only, so all appointments that fall within 24 hours of the present time will be unavailable to book on our booking site. Also you are able to book up to three months ahead of the present time but not to any future dates beyond that.

5.1.4. If you are late for your appointment it will still end at the scheduled time and the session time may not be recovered. If you can, please reschedule your appointment instead of being late from it.

5.1.5. Free online consultations and any other free of charge Services shall not be rescheduled, unless the Instructor or NST allows the User to re-book or reschedule the appointment. Once a User booked a session for a free service, that User can not book the same type of session again. NST reserves the right to cancel any future free consultation booking of the same User, and even ban the User from booking the free service again.

5.2. Cancellation Policy
​
5.2.1. Definitions; understanding the difference between cancellation and reschedule.
​
To cancel, canceling, cancellation: in these terms and conditions all these words mean the termination of the purchased booking either by the User, the Instructor or by NST. A canceled booking can not be delayed to a later date, can not be reinstated and the Service will not be given to the User on the originally booked time and date of the booking.
A refund may be released to the User upon a cancellation.

To reschedule, rescheduling: in these terms and conditions these words do not mean the termination of the purchased booking either by the User, the Instructor or by NST. A rescheduled booking can be delayed to a later date, can be re-booked in the NST booking system and the User can receive the original Service that has been purchased at some point in the future.
No refund can be released to the User upon a reschedule.

5.2.2. You may cancel or reschedule your NST bookings anytime. You are allowed to cancel or reschedule any number of times within reason. This means that if you reschedule your appointment for NST service(s) too many times without reasonable explanation, you may not be allowed to reschedule any further or in extreme circumstances NST reserves the right to refuse to provide the purchased service(s) to you without releasing you a refund.
5.2.3. If you would like to change the date or time of your appointment and not to cancel it completely, please do not use the “cancel” button on the “my bookings” page of your NST account. Please get in touch with Søren Sedit instead via email and ask him to reschedule your NST appointment(s). If you cancelled your appointment already but would like to reschedule it, please also enquire about this by emailing Søren.

5.3. Refund Policy
​
5.3.1. In case of a cancellation, a refund may be issued to you. NST reserves the right not to issue full refunds to Users, due to the administrative and technical challenges NST faces upon initiation of a refund process. Payment processing fees are still applied to the online card payments upon both the purchase and refund process. Due to the previously mentioned reasons, NST can only release 90% of whatever original amount the User paid for the Services upon purchasing.
5.3.2. The only exception to the previous (5.3.1.) section is where due to unforeseen reasons, due to NST’s or the Instructor’s fault, such scenarios like the Instructor is being unavailable for sessions for any unforeseen reasons, or NST finds that a particular event that highly affect the treatment and / or the patient impacting negatively the Service we give to the User, and therefore we can't continue the treatment for safety reasons. In such cases NST may release a full refund to the User, however it can not be guaranteed. In such cases NST either issues a 100% or 90% refund, depending on the circumstances and some other payment processing factors that may affect the nature of the refund.
5.3.3. Please note that refunds can take up to 5 - 10 working days from the date of the issue to complete.

7.2. Additional notes regarding the NDA

7.2.1. As it is explained on the FAQ page of this website, Neuro Sound Treatment has the exclusive right to use some parts of the Master-Key Vocal System's trademark and copyrighted intellectual property to use it within NST's advance sound healing technique to treat various dysfunctional mental conditions.
During your treatment, NST uses the essential parts of MKVS' confidential segments, therefore we need your complete and irreversible cooperation and undertaking that you keep the details of the entire treatment highly confidential for as long as the NDA requires from you to do so.

7.2.2. All NST exercises and materials that are used during the sessions are protected and owned by NST’s and MKVS' exclusive copyright, and therefore distributing, copying, selling and any personal, public or business use of these are strictly prohibited, with the exception of the prior permission of NST or MKVS.
Furthermore, audio, video, image capturing or any kind of recording of the sessions by you are strictly prohibited, with the exception of the prior permission of NST or MKVS.

If we gain knowledge about a possible breach of any of the previously mentioned restrictions caused by you, this will be thoroughly investigated and we reserve the right to take legal action against you for causing significant business loss to NST. Furthermore, all of your existing prepaid bookings with NST will not be refunded definitely and you will be banned as a User in the future permanently.

Please note that if you break any of the terms and conditions written within the Non Disclosure Agreement, in the NDA section of this Site and within the entire Terms and Conditions on this Site (https://www.nstreatment.org/terms) intentionally or unintentionally a lawsuit and / or copyright claim will be issued against you and we reserve the right to take all possible legal actions against the copyright and / or trademark related offences that may have been caused by you or by a third party.
